After Riccardo Spagni was arrested by U.S. law enforcement on July 21, 2021, the U.S. court has now ruled that the former main maintainer of Monero is not allowed to bail. In its ruling, the court found that Spagni, also known as “Fluffypony”, did not make a convincing argument that he did not risk flying.

Spagni’s crypto assets pose a risk of escape for him

On the contrary, according to a report, the court accepted the argument of the US law enforcement agency that Riccardo Spagni’s important cryptocurrency assets would pose him a risk of escape. At the same time, Spagni’s failure to obtain bail means that the South African government can now submit a surrender document during his detention.

Spani faces charges of defrauding his former South African leader Cookie Corner and is currently in detention, so he will not leave the country before the case is over. In turn, this unofficial departure from the United States prompted the city’s official court to issue an arrest warrant for Spani.

Once Spani’s private jet was intercepted while refueling in the state capital of Tennessee, the U.S. Marshals could use this arrest warrant to arrest and detain him.

Track Spagni’s movements

At the same time, court documents describing the events that led to Spani’s arrest suggest that before the arrest, the US Marshal’s workplace had been informed of Spani’s travel itinerary on the relevant day. However, these documents collectively prove that the appearance of the Spagni name on the airline passenger list determines the fate of cryptocurrency developers. The document states:

“When the charter manifest was submitted, Spagni’s name triggered a red notice, marking him as the subject of an international law enforcement request.”

Nonetheless, as the U.S. Senior Deputy Marshal Ashley Allen explained in court, before Spaney was arrested on July 21, law enforcement may still solve his problems, but this did not happen.

At the same time, court documents recommended that the South African government have 60 days to submit the required documents to the United States for a surrender hearing. This era is ready to end on September 19, 2021.
